Fan Favorite, Inc. ("Fan Favorite," "we," "us," or "our") operates fanfavorite.com and our retail locations in Massachusetts. This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and the rights and choices you have. It applies to our website, our online store, our email and text communications, and our in-store point-of-sale systems.

Information you provide to us:

• Contact and account information — your name, email address, shipping and billing address, and phone number when you place an order, create an account, subscribe to our emails, or contact customer service.
• Order information — the products you purchase, order history, and gift recipient details you provide.
• Payment information — your payment card or payment account details. Payments are processed by our payment providers (including Shopify Payments, Shop Pay, PayPal, Apple Pay, and Google Pay). We do not store full payment card numbers on our own systems.
• Communications — messages you send us by email, phone, social media, or through our website.

Information collected automatically:

When you visit our website, we and our service providers automatically collect certain information from your device, including your IP address, browser and device type, operating system, referring pages, the pages and products you view, and the date and time of your visit. This information is collected through cookies, pixels, and similar technologies (see Section 4). This information is personal information under applicable privacy laws, and we treat it as such.

Information from other sources:

We may receive information about you from our e-commerce platform (Shopify), payment processors, shipping carriers, marketing platforms, and social media platforms when you interact with our content or ads.

2. How We Use Your Information

• Process, fulfill, and ship your orders, and send order confirmations and shipping updates
• Provide customer service and respond to your requests
• Send marketing emails and, where you have opted in, text messages (you can unsubscribe at any time)

• Analyze how our website is used so we can improve it

3. How We Share Your Information

• Service providers — companies that help us run our business, including Shopify (our e-commerce platform), payment processors, shipping and fulfillment carriers, email and SMS marketing providers, and customer service tools. These providers are permitted to use your information only to provide services to us.

Opting out of marketing does not affect transactional messages such as order and shipping confirmations.

• Right to know / access — request a copy of the personal information we have collected about you
• Right to delete — request that we delete your personal information, subject to legal exceptions (for example, records we must keep for completed orders)
• Right to correct — request that we correct inaccurate personal information
• Right to opt out of targeted advertising and the sale or sharing of personal information — via the cookie banner, the "Do Not Sell or Share My Personal Information" link in our footer, the Global Privacy Control signal, or by contacting us
• Right to non-discrimination — we will not deny you goods or services, charge different prices, or provide a different level of service because you exercised your privacy rights

How to exercise your rights: Email cs@fanfavorite.com with the subject line "Privacy Request," or call (617) 249-4941. We will verify your identity before fulfilling a request, typically by matching the information you provide against the information in our records. You may designate an authorized agent to submit a request on your behalf; we will require proof of the agent's authority.

Response timing and appeals: We will respond to verified requests within the time required by applicable law (generally 45 days, with an extension where permitted). If we decline your request, we will explain why, and where required by your state's law you may appeal our decision by replying to our response with the word "Appeal." If your appeal is denied, you may contact your state Attorney General.

7. Residents of Canada

We ship to Canada. If you are located in Canada, we collect, use, and disclose your personal information as described in this policy with your consent or as otherwise permitted by law, in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws, including Quebec's Act respecting the protection of personal information in the private sector. Canadian residents may request access to or correction of their personal information, or withdraw consent to certain uses, by contacting cs@fanfavorite.com. Our privacy contact for these purposes is Fan Favorite Customer Service at the address in Section 12.

8. Children's Privacy

Our website is a general-audience store and is not directed to children. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of consumers under 16. If you believe a child has provided us personal information, contact us at cs@fanfavorite.com and we will delete it.

9. Data Retention

We keep personal information for as long as needed for the purposes described in this policy — for example, order records are retained as required for accounting, tax, and warranty purposes; marketing data is retained until you unsubscribe or ask us to delete it. When information is no longer needed, we delete or de-identify it.

10. Security

We use commercially reasonable safeguards to protect personal information, including encrypted (HTTPS) connections and PCI-compliant payment processing through our payment providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and revise the Effective Date above. Material changes may also be announced by email or a notice on our website.
